The essay enquires into the relationships between general clauses - good faith and fair dealing - and employees’ obligation position in the employment relationship. After refuting the idea that the employee is exempted from duties of good faith and fair dealing, the Author suggests a configuration of these as "duties of protection", so to integrate contractual regulation. Then, she looks for the differences both with the duty of care and obedience and the duty of loyalty. The conclusion of the analysis is that articles 1175 and 1375 of Civil Code can only be applied in the areas vacated from current legislation (articles 2104 and 2105 of Civil Code), from collective agreements and also from codes of conduct if they’re of a constraining sort.
