The essay focuses on the topic of the dismissal on the ground of age of young workers on call. Moving from a recontruction of the development of the Italian regulation concerning job on call, the investigation will analyse the case-law of the national courts and of the European Court of Justice in the Abercrombie case, in order to verify the legitimacy of a regulatory framework, such as the Italian one, authorising an employer to dismiss an on-call worker as soon as he reaches the age of 25 years.
