Starting from main legal references and the most recent rulings of the Supreme Court concerning the evaluation of the child’s witness in the criminal trial where he is involved as victims of a sexual crime, this contribution aims to examine the necessary interaction between the judge and the expert, essential to outline a new horizon of protection for the child, consisting in his active and conscious participation in the trial, in which he cannot, and must not, become a victim.
