In addition to EU legislation, international labour standards from the International Labour Organisation and the European Social Charter are becoming more and more important in Spain. The two most important rulings of the Supreme Court in 2024 concern dismissal in the light of ILO Convention No. 158. The Supreme Court has ruled in July 2025 about the controversial Article 24 of the revised European Social Charter soon, after the European Committee of Social Rights has already criticised the Spanish regulation, as it did before with the Finnish, Italian and French regulations. Conforming interpretation and diffuse conventionality control are judicial techniques that are increasingly present on the Spanish labour scene.
Keywords: International labour standards; ILO; European Social Charter; Spanish case-law; Dismissal; Conventionality control.
