Legal science uses the adjectives ‘postmodern’ and ‘liquid’ to define contemporary legal experience. The multiplication of sources, overlapping between the legal orders of states and of extra-state systems and the reduction in strict sovereignty over territories to the benefit of decentralised forms of regulation that extend across supranational areas are the most incisive elements in an institutional panorama that seems to have overturned modernity’s political set-up. A closer look reveals that the greater liquidity of the rules produced by extra-state processes, which often focus on the leading role of private stakeholders, does not betray the modern order’s original logic, whose purpose is to guarantee the mercantile economy’s "spontaneous" dynamic, while reserving the task of using coercion to manage social conflicts for public authority.
