La costituzione rassicurante. Nota critica sulla teoria dei poteri d'emergenza di Bruce Ackerman

International terrorism represents a new challenge for theories of emergency powers; for that reason it forces a rethink of the usual constitutional framework used to deal with emergencies. This essay analyzes Bruce Ackerman’s emergency constitution and tries to evaluate its potentialities. It begins by casting Ackerman’s proposal into the contemporary debate by comparing it with other proposals. The main point of interest is to shed light on the principle of reassurance which constitutes the basis of Ackerman’s theory. In the end, it turns out that the emergency constitution aims more at making people feel safer than actually making them safer. However, the essay concludes that the emergency constitution has some insights like the idea of a «supermajoritarian escalator» worth being developed even in other constitutional systems.;
