The Court of Cassation has upheld the damages award imposed in the lower courts against a municipality that regularly organises cultural events during the summer, often held in the main square. The action was brought by two property owners near the square, who complained that they were unable to enjoy a peaceful stay at their summer residence due to excessive noise from cultural events. Following the case, the Court ruled that a municipality is also required to refrain from causing noise pollution, which must be assessed on the basis of the specific situation, considering locations, times, characteristics of the area, and the habits of its residents.
