The increasing attention by consumers to environmental concerns has caused the diffusion of green claims in advertising. When unsubstantiated or misleading, such claims are known as “greenwashing”. This article analyzes some recent rulings of ASA relating to airlines and cruise operators and then examines the Italian practice in relation to greenwashing. The legal background of such practice is to be found in UE law and particularly directives 2005/29/CE and (UE) 2024/825.
